Belgium Regulations

Decriminalized (2022)

Belgium enacted one of Europe's most progressive sex work reforms in 2022, fully removing sex work from the penal code and granting workers access to labor rights, social security, and legal protections.

Penal Code Reform (2022)

Since June 1, 2022 sex work is no longer a criminal offence under the Belgian penal code. Third parties may facilitate sex work provided there is no exploitation, coercion, or trafficking.

Labor Law

Sex workers may enter into employee contracts with recognized employers. They are entitled to social security coverage, pension contributions, health insurance, and unemployment benefits — the same as any other profession.

Right of Refusal

The right to refuse any client or any sexual act at any time is explicitly protected by law. Contracts may not override this right, and enforcement is backed by criminal sanctions.

Third-Party Facilitation

Operators and managers of sex work venues may operate legally if they hold a municipal permit, respect labor law, and demonstrate no exploitation. Exploitative facilitation remains a serious criminal offence.
